1. Posting a rating or other information on this Site or creating a link to other information

1.1 You will use the rating system on this Site fairly and honestly, giving a balanced and truthful indication of your own personal experience in the immediately preceding 6 months and opinions that you genuinely hold.

1.2 You agree that your opinion will not identify any individual except the doctor whom you are reviewing and that any opinion you give about any other person, practice, hospital, service, or product (either directly or through the creation of any link) will be an honest and truthful reflection of your own personal experience during the immediately preceding 6 months and will include only opinions that you genuinely hold.

1.3 You agree that you will not rate any doctor or post any material to the Site (either directly or through a the creation of a link) about any doctor unless you (or a person for whom you care) consulted or was treated by that doctor during the 6 months immediately preceding the date on which you posted the rating or other information, or you have been a colleague of that doctor within that 6 month period.

1.4 You agree that any factual information that you post to this Site (or to which you create any link) about any doctor, practice, hospital or service will, to the best of your knowledge and belief, be accurate and up to date as at the date of your posting.

1.5 You must not post or create a link to any information about any person, practice, service or product with whom or about which you are (or any person for whom you are a carer is) or have been involved in any form of investigation, complaint or litigation.

1.6 You will not distort or try to distort the ratings and comments that appear on this Site, nor seek to influence any other person’s rating of any doctor, or their comments on any doctor, practice, service or product on this Site and you will not encourage or induce anyone else to rate or review any doctor, practice, service or product in support of your views or the views of anyone except the person posting the rating or review.

1.7 You will not use this Site to make any personal attack on anyone.

1.8 You cannot rate more doctors or make more reviews than the automated limits permit without first obtaining permission from iWantGreatCare.

1.9 Although doctors are encouraged to post their own personal details on this Site, and to contact iWantGreatCare if they wish to correct any information about them on this Site or to object to any inaccurate or misleading posting about them on this Site, no doctor will post any rating or other information about himself on this Site. Likewise, no member of his or her family will post any rating or other information on this Site about a doctor to whom they are related.

1.10 You will not post, create any link to, or otherwise make available through this Site, any defamatory, obscene, indecent, lewd, pornographic, violent, abusive, offensive, insulting, threatening, menacing, unlawful or blasphemous message or material.

1.11 You will not post, create any link to, or make available through this Site, any material that:

1. is an invasion of privacy;
2. is a breach of any data protection principle or legislation;

3. is a malicious falsehood or seditious libel;
4. is a contempt of court;

5. is likely to incite or capable of inciting violence, racial hatred, sadism or cruelty; or
6. encourages any unlawful or illegal act or omission.

1.12 You will not post, or create any link to, or make available through this Site, any personal data except data about the doctor being reviewed and, if you choose, personal data about yourself. In the case of personal data about yourself, you grant iWantGreatCare explicit permission to publish that personal data on this Site.

1.13 You will not post, create a link to, or make available through this Site any statement that you know, or have reasonable grounds to believe, is or is likely to be understood as encouragement or other inducement to prepare, instigate or commit acts of terrorism.

1.14 You will not post, create any link to, or make available through this Site, any material that is intentionally false or that is misleading, or that causes annoyance, inconvenience or needless anxiety to anyone, or that is potentially damaging or harmful

1.15 You will not impersonate anyone else, whether or not a public figure.

1.16 To assist iWGC to check their identity of anyone who posts a rating or other information on this Site:

a) doctors who engage with this Site must use their Doctors.net.uk or NHS.net email address; and

b) anyone who engages with this Site must use their own usual email address, and not a temporary or group email address.

 

1.17 You will not falsely state or falsely represent that you are connected to, or affiliated with, any individual or entity.

1.18 You will not use this Site to promote or advertise or to engage in any other form of marketing, including (without limitation) chain letters or pyramid selling, even if you are acting on behalf of a non-profit-making organisation or a charity.

1.19 You will not post, create any link to or make available through this Site, any material that is protected by copyright, database rights or any other intellectual property rights unless you are the owner of those rights, or you have the permission of that owner to publish that material in that way.

1.20 You will not post, create any link to or otherwise make available any information that is confidential to anyone else.

1.21 You will not use this Site to manipulate the market for any security, or to offer, sell or buy any security or in any way that is in breach of any rule or regulation relating to financial services.

1.22 You will use this Site only for lawful purposes, not knowingly break any law or regulation whilst using this Site and not use this Site in a way that infringes the rights of anyone else.

1.23 You will not use this Site in a way that restricts or inhibits anyone else's use and enjoyment of this Site.

1.24 You will not post or create a link to any file that contains any virus, corrupted data, Trojan horse or anything else that might damage, destroy or render inaccessible any data or files on any computer.

2. Breaches of these Terms

2.1 iWantGreatCare may monitor any material posted or otherwise made available to this Site, although it is not obliged to do so.

2.2 iWantGreatCare may, at its discretion, refuse to allow any rating or other material to be posted on this Site, or delete, edit, block or permanently remove or disable access to any rating or material posted to this Site, at any time, and without having to have or give any reason. In particular, iWantGreatCare reserves the right to remove or disable access to, in each case without notice, any rating or material that it decides is, potentially, defamatory an infringement of a third party’s copyright, database rights or other intellectual property rights.

2.3 iWantGreatCare will determine, in its discretion, whether there has been a breach of any of these Terms. If it believes a breach has occurred, IWantGreatCare may take such action as it think fit. Your failure to comply with these Terms may result in our taking one or more of the following actions:
1. an immediate, temporary or permanent withdrawal of access to this Site;
2. an immediate, temporary or permanent removal of any rating or material posted to this Site;
3. checking any rating or material before it is allowed to go onto this Site;
4. issuing a warning email, informing you why your rating or posting has been refused or edited;
5. instigating legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
6. taking further legal action against you;
7. disclosing any information (including personal data such as email addresses and IP addresses) to law enforcement authorities or other relevant third parties as iWantGreatCare thinks appropriate to assist them to identify and locate anyone who may have committed an unlawful or illegal act;
8. reporting any doctor who posts a review of him or herself on this Site or who distorts or attempts to distort any ratings or comments on this Site, to the General Medical Council for professional misconduct; and
9. publishing details on this Site of any doctor who posts a review of him or herself on this Site or who distorts or attempts to distort any ratings or comments on this Site.

The reaction of iWantGreatCare to any breach of these Terms are not limited to those described above, and iWantGreatCare may take any other action, as it sees fit.

2.4 iWantGreatCare reserves the right to suspend any rating, review, information or service at any time without notice.

3. Children

3.1 This Site is intended to be used only by people who are 18 years of age or older. Any use of, or access to, this Site by anyone who is under 18 is unauthorised, unlicensed and a breach of these Terms. By using this Site, you warrant that you are 18 years of age or older.

 

4. Personal Data

4.1 For details of the personal data that iWantGreatCare collects and the purposes for which iWantGreatCare uses your personal data please read our Privacy Policy. Whenever you provide us with your personal data, you are consenting to its collection and use in accordance with our Privacy Policy.

5. Intellectual Property and Other Rights

5.1 By posting any material (including any text, photographs, graphics, video or audio) to this Site (either directly or by creating a link), you are granting to iWantGreatCare, free of charge, a non-exclusive licence to use that material in any way it sees fit (including copying, modifying and adapting it, publishing it and granting the rights in Condition 5.3) indefinitely. You waive your moral rights in relation to any review or material that you post to this Site, including your right to be identified as its author.

5.2 You warrant that any material you post to this Site (either directly or by creating a link):
a) is your own original work;
b) is not defamatory;
c) does not infringe any laws in force in the United Kingdom;
and that:
d) you have the right to give permission to use it for the purposes specified above; and
e) you have the consent of any individual mentioned in the material and who is identifiable (or the consent of their parent or guardian if they are under 16) for the use of their personal data for those purposes.

6.2 If you wish to object to any rating or material posted to this Site, please contact us at adminservices@iwantgreatcare.org, or use the ‘Report this review’ link provided on this Site. We will then review the rating and the material about which you have complained and decide whether it complies with these Terms. We will inform you of the outcome of our review within a reasonable time after receiving your complaint.

6.3 If you believe that that any material on this Site infringes any copyright or other intellectual property rights that you own or control, please send written notification to adminservices@iwantgreatcare.org. That notification must include:1. a description or copy of the work that you claim has been infringed;
2. evidence that you are the owner of the intellectual property rights in the work or that you are authorised to act on behalf of the owner;

8.10 Each person who posts a rating or any other material or information on this Site (either directly or through any creating any link) will indemnify iWantGreatCare and will keep iWantGreatCare fully indemnified against all and any claims made by any third party against iWantGreatCare that arise in connection with any rating or other material or information posted by that person, including any and all costs, expenses, losses and liabilities incurred by iWantGreatCare in connection with defending or settling that claim.
